Bitter Trademark Dispute Ends

A 'bitter' trademark row came to an end this week, according to reports in the UK media.

It has emerged that the Edinburgh Brewing Company has won permission to use 'Edinburgh Pale Ale' as a trademark, despite protests from rival firm Caledonian Brewery that this would infringe on its 'Edinburgh Strong Ale' mark.

Delivering his verdict in the case, Judge George Salter dismissed Caledonian's secondary claim that the name was misleading, as the beer is not brewed in Edinburgh, and stated that:

"In my opinion, the differences between the marks are more than enough to prevent members of the relevant public from being led to believe that the goods offered by the applicant are goods of the opponent, or that the businesses are connected."
