According to a Royal Gazette report published on Friday, the Bermuda Industrial Union has failed in its attempt to prevent a judge ruling on an important labour case.
BAS-Serco, a Bermudian company is challenging a decision made by a government-appointed tribunal two years ago which ruled that within the BAS-Serco workforce, union firefighters could form one bargaining unit and non-union members another, arguing that this arrangement creates confusion.
Speaking in the Supreme Court on Thursday, according to the Royal Gazette, BIU lawyer Delroy Duncan argued that Assistant Justice Philip Storr did not have the authority to rule upon the tribunal's verdict. However, the local newspaper revealed that:
'After representations from BAS-Serco lawyer Alan Dunch, Mr Storr threw out the BIU's objection and continued with the hearing which both sides say will affect union/employer relations across the island.'
