It emerged last week that the challenge lodged by the Barcelona City Council to the registration of barcelona.eu as a domain name has been upheld by the dispute resolution centre for .eu, which is attached to the Czech Arbitration Court.
During the phased registration, or 'sunrise' period of granting .eu domains, a Dutch firm, Traffic Web Holding BV applied for ownership of barcelona.eu.
The mark on which it relied was a Benelux trademark, granted on 30th November 2005, which comprised the words BARC & ELONA, in blue and in a stylised upper case, the words being placed in between two parallel horizontal lines, each line being comprised of small red squares.
Other Benelux marks for other European cities were lodged in a similar form by Traffic for many other European cities, such as AMST & ERDAM, ATH & ENS, BIRM & INGHAM and so on. Similar applications were made for the names of various countries (BEL & ARUS, BO & OSNIA etc).
The dispute resolution panel argued that the application should not have been accepted by EURid or the validator, PricewaterhouseCoopers.
It is not yet known whether the name will be automatically transferred to the Barcelona City Council, or whether the authority will simply jump to the head of the registration queue for the domain in question.
