The UK Appeals Court has ruled that Victor Chandler's Gibraltar offshore betting operation cannot after all advertise on UK teletext pages.
In July, 1999 the High Court had ruled that Victor Chandler was not breaking the Betting and Gaming Act by advertising in this way, but the Appeal Court has disagreed. The firm was intending to use its computers in Gibraltar to place ads on the UK teletext pages, and the Chairman of the Court, Sir Richard Scott, said that he could see no difference at all between documentary advertising placed from offshore (banned by the Act) and advertising placed electronically on television screens.
The ruling is a setback for offshore betting and gaming, but only a minor one, since punters now know where to find the offshore bookmakers on the Internet, and will continue to be drawn away from UK firms by the price advantage offered from tax-free offshore jurisdictions.
