ACEC Prepares for Dallas, But Still Heading for Stalemate

The U.S. Advisory Commission on Electronic Commerce (ACEC) will hold its final meeting in Dallas, Texas next week and in preparation for the meeting, ACEC members have submitted their latest proposals and amendments.

Recent reports on uncertainty and dissension within its ranks indicate that Chairman James Gilmore will have a tough time getting ACEC members to agree to concrete proposals that he can offer up to Congress. With the latest batch of amendments submitted by ACEC members, that task will be even harder as complex non-tax related issues have been thrown into the mix such as privacy concerns and the impact of the 'digital divide'.

As far as internet taxes are concerned, ACEC is now down to two choices - ACEC Chairman James Gilmore's proposal for a permanent ban on all internet taxes; and National Governors Association Chairman Mike Leavitt's plan to modify existing laws to allow states to collect tax on on internet sales and online activities.

The only common ground that appears to exist between these two strongly divided camps is for a three to five year extension on the current internet tax moratorium while both state and federal regulators take a harder look at both the virtues and mechanics of collecting taxes online. Unless there is a miracle in Dallas next week, it appears that this third way will be the only recommendation that ACEC is able to make when it delivers its report to Congress on April 21.
