USPTO Comes Out In Favour Of RIM
The US Patent and Trademark Office (USPTO) this week came out in favour of
Research In Motion in its long-running dispute with NTP over ownership of the
e-mail 'push' technology contained in the former firm's BlackBerry devices,
signalling its intention to reject the patents at the heart of NTP's claims. The Office rejected two of the five patents in question in "non-final
actions", but stated that although NTP can appeal the rulings, the end
result will be the same. In a statement, the USPTO explained that: "The present Office Action would have been a final Office Action but for
(a) new rejection based on a Norwegian Telecommunications Administration printed
publication that was made of record in (a) related re-examination proceeding." It went on to add that: "The present Office Action is non-final, even though the Patent Owner's
arguments were deemed unpersuasive. The next Office Action is expected to be
a final Office Action." Whatever the eventual outcome of the RIM-NTP dispute, the BlackBerry manufacturer's
legal woes are far from over, as it emerged last week that the firm is facing
a patent infringement claim lodged in the UK by Luxembourg-based IP firm, Inpro. .
