Microsoft Appeals EU Fine

It emerged this week that Microsoft has lodged an appeal with the Court of First Instance (CFI) over a fine imposed on it by the European Commission for non-compliance with an earlier antitrust ruling.

The disputed EUR280.5 million fine covered the period from last December to June 20 at the rate of EUR1.5m per day.

Commenting in July when the fine was handed down, Microsoft's General Counsel, Brad Smith announced that:

"We do not believe any fine, let alone a fine of this magnitude, is appropriate given the lack of clarity in the commission's original decision and our good-faith efforts over the past two years. We will ask the European courts to determine whether our compliance efforts have been sufficient and whether the commission's unprecedented fine is justified."

The deadline for lodging an appeal against the fine was October 2. It is not yet known whether it will be heard in conjunction with the ongoing legal dispute between Microsoft and the European Commission or separately.
