Lord Falconer To Urge Law Society To Accept 'Tesco Law' Reforms

UK Lord Chancellor, Lord Falconer is to speak at a forthcoming Law Society council meeting on December 17, in an attempt to persuade the legal community's industry body to accept proposed reforms to the sector, which have been dubbed the 'Tesco Law' reforms.

One of the key proposals which the government is keen for the legal services regulator to accept is to allow lawyers to pay for referrals by non-legal professionals.

Although the Law Society voted at its October meeting to reject such an arrangement, (despite the threat of legal action from the UK's Office of Fair Trading), a compromise proposal has reportedly been put forward by a council member.

This would allow lawyers to pay referral fees to non-lawyers on the understanding that the client is made aware of the arrangement by the non-lawyer at the first available opportunity.

Observers have suggested that the amended referral fee proposal is likely to win far more support from Law Society members, who have already voted to allow solicitors to share fees with non-lawyers in certain cases.
