Hong Kong, Ireland Agree On Mutual Legal Assistance

The governments of Hong Kong and Ireland signed a treaty last week agreeing on Mutual Legal Assistance in Criminal Matters. The agreement covers the major aspects of mutual assistance including: the serving of documents; taking evidence; executing requests for search and seizure; transferring persons to appear as witnesses; and identifying, tracing, restraining, forfeiting and confiscating proceeds and instrumentalists of crime.

The Mutual Legal Assistance in Criminal Matters Ordinance is already in place in Hong Kong providing for the necessary legislative support for the implementation of the agreement. It will enter into force 30 days after both sides have notified each other in writing that their requirements for the entry into force of the agreement are in compliance.
