EU To Press Ahead With Antitrust Action Against Microsoft
by Ulrika Lomas, for LawAndTax-News.com, Brussels

12 November 2004

Despite the announcement on Monday that Microsoft has reached a settlement with Novell Inc. and the Computer and Communications Industry Association, causing them to withdraw from the antitrust case that has been brought against the software giant by the European Union, it has emerged that the EC intends to push on with the action regardless.

Microsoft has requested the staying of record sanctions until the appeals process has been concluded, and this is currently being considered by the Court of First Instance in Luxembourg, with a verdict expected in the next few months. However observers suggest that the overall appeal may not be concluded much before 2008-09.

Although RealNetworks Inc. is now the only major representative of the computing industry backing the EU's campaign, Amelia Torres, spokeswoman for Competition Commissioner Mario Monti announced that Novell and the CCIA's decision "changed nothing".

"Antitrust enforcement by the Commission does not depend on complaints by individual parties, but is geared towards protecting the interests of consumers," she added.
