Canadian Newspaper And Freelance Writers Battle It Out In The Supreme Court

A class action battle in Canada's Supreme Court over the ownership of rights to articles reproduced electronically began on Tuesday.

The dispute originated in 1996, when freelance journalist Heather Robertson launched a legal action against The Globe and Mail newspaper, calling for additional compensation for freelancers when their articles are resold on CD-ROMs or included in online databases.

Several related appeals will also be heard by the Supreme Court, as the lower courts have been divided on the matter.

In recent years, journalists in both the US and Canada have been required to sign contracts that passed over the rights to electronic distribution of their articles to the publisher; but there remains a mass of material pre-dating the new contracts.
